1Opinion of the CourtCoshow, J.

There is no claim here that the complaint does not state sufficient facts to constitute an action against defendant. There is no serious claim made that defendant was free from negligence. It is ably argued and seriously contended here that the complaint states facts showing plaintiff to have been guilty of contributory negligence. It is also earnestly urged that plaintiff’s testimony affirma tively shows that his injuries are the result of his own lack of care. It is admitted that plaintiff’s negligence would prevent his recovery if that negligence contributed to his injuries.
