ROSS, Circuit Judge.
This action was brought under 42 U.S.C. § 1983 for damages arising out of an incident at the McLaughlin, South Dakota police station on November 3, 1973. The plaintiff Delores Taken Alive, an Indian woman, sued Melvin Litzau, a city police officer, for injuries caused by Litzau during the course of what Litzau claimed was an arrest. The plaintiff also sued Robert Quinn, Chief of the McLaughlin City Police Department, for damages based on Quinn’s allegedly negligent supervision of Litzau.
