This appeal brings under review the proceedings in the trial of a tort action, in which the plaintiff was awarded a verdict and judgment in the sum of $10,-000.00, actual damages. The action was brought against the defendant to recover damages for injuries resulting from an explosion of gasoline which, it is alleged, was purchased as kerosene for domestic use.

The first ground of appeal is that the trial court committed error in refusing appellant’s motion for a directed verdict based on the ground that the evidence failed to show actionable negligence on the part of appellant…
