WINGATE, District Judge.
Before the court are the motions for summary judgment filed by defendants, The City of Jackson, Mississippi, and Westwood L.P. Defendants bring their motions pursuant to Rule 56(b), Federal Rules of Civil Procedure. 1 By their motions, these defendants contend that under the undisputed facts and applicable law they are entitled to a judgment in their favor as a matter of law.
