Plaintiff, Isadore Gumbiner, filed an amended and supplemental complaint in the circuit court of Cook county seeking to have declared invalid, and an injunction issued restraining consummation of, a written agreement entered into December 29, 1943, between defendants, Alden Inn, Inc., as seller, and Lake Shore Hotel Company, as purchaser, involving the sale of a parcel of real estate in Chicago, improved with a building used for hotel purposes, together with furnishings, constituting the sole assets of the seller corporation.
