The declaration is in three counts, two of which are now involved. The record gives no information concerning the disposition made of the third count, which is for slander.

The first count avers that, although the plaintiff was innocent, the defendant falsely, maliciously, and without probable cause accused her of the theft of merchandise from its store, whereupon it caused her to be arrested and imprisoned on said charge, without the prior making of any complaint or the issuanc'e of any warrant authorizing her detention; and that she was discharged from arrest without.having been brought…
