I. Background
On November 30, 2001 the defendant, Michael Boria, was convicted by a jury in this Court of 1) three counts of aiding and abetting possession with intent to distribute heroin, 2) two counts of possession with intent to distribute heroin and 3) two counts of possession with intent to distribute methamphetamine. He was sentenced to 327 months in prison pursuant to the guideline sentencing range (“GSR”) for career offenders. See United States Sentencing Guidelines (“USSG”) § 4B1.1.
