This case is an appeal from the trial court’s determination that the decision of a special hearing examiner, as adopted by the Brier City Council (City Council) in resolution 370, was not arbitrary, capricious, or unlawful, except as modified by the trial court. The City of Brier (City) cross-appeals part of the decision wherein the court held that both parties were prevailing parties, thus precluding an award of attorney fees and costs.
