Appellants are former air traffic controllers who were discharged by the Federal Aviation Administration (“FAA”), after the Professional Air Traffic Controllers Organization (“PATCO”), strike in August 1981. The controllers in this action brought suit in federal district court on April 20, 1982, alleging that the FAA deprived them of one of their statutory appeal routes under the Civil Service Reform Act by sending out misleading notices upon their discharge.
