MEMORANDUM
DUBOIS, District Judge.
Presently before the Court is Defendants’ Motion to Dismiss Plaintiffs’ Third Amended Complaint and Defendants’ Motion to Transfer Count I of Plaintiffs’ Third Amended Complaint to the United States Court of Federal Claims (hereinafter “Court of Federal Claims”) In the Alternative to Dismissal. For the. reasons which follow, Defendants’ Motion to Dismiss Plaintiffs’ Third Amended Complaint will be denied and Defendants’ Motion to Transfer Count I to the Court of Federal Claims will be granted.
