HOLLINGSWORTH, Judge.

Upon trial by jury in the Circuit Court of' Wayne County, defendant was found guilty of embezzlement of the sum of $61.50 of public moneys that came to him by virtue of his office as sheriff of said county, as that offense is defined in § 560.280. (All statutory references herein are to RSMo 1949 and V.A.M.S.), Defendant’s punishment was assessed at imprisonment in the State Penitentiary for a term of two years.
