WARRINGTON, Circuit Judge.

Baird, a citizen and resident of Oklahoma, recovered, judgment in the court below against the county of Ohio, Ky., on the following instrument:

“On or before the first day of August, 1894, the Ohio county fiscal court and Ohio county promises to pay to the order of A. B. Baird at the Beaver Dam Deposit Bank five thousand eight hundred and ninety-two dollars and forty-three cents ($5,892.43), out of the first of the county levy of J894, collected by the sheriff of said county as per order of said court made at its January, 1904, term.
