Bruce Foreman, as administrator of the estate of Robert T. Foreman, deceased, sued the Missouri Pacific Railroad Company and Cuy A. Thompson, as trustee of said company, and J. L. Fisk and C. H. Hensley, engineer and fireman, respectively, in the circuit court of Hot Spring county, alleging that Robert T. Foreman was struck by a train while attempting to cross the tracks of the appellants at a public crossing in the city of Malvern on the night of November 1, 1935; that the said Robert T.
