Consideration will first be given to the general demurrers filed by both defendants. Unless otherwise noted, the discussion will be directed to the complaint in the case against Multnomah County.

The first and fundamental question of law for our decision may be stated thus: Public funds, the property of a county, are placed on deposit to its credit in a bank, the county treasurer draws a check against thé fund, the signature thereon is followed by the words “County Treasurer”, the cheek is delivered to the payee named therein in payment of a claim which the payee has against the drawer as a…
