1. INTRODUCTION
This matter is before the Court on cross motions for summary judgment: Defendant’s Motion for Summary Judgment [Docket No. 68] and Plaintiffs Motion for Entry of Judgment [Docket No. 74]. The Court heard oral argument on December 2, 2011.
II. SUMMARY OF THE COURT’S OPINION
