This is an action of trespass on the case, brought by Harry Fleming, a minor, by Clarence Fleming, his father and next friend, plaintiff, against the City of Chicago, defendant, to recover damages for personal injuries.
The declaration contains one count to which the defendant pleaded the general issue, and the case was tried before the court and a jury, and resulted in a verdict for the plaintiff in the sum of $5,000; and the court, after overruling motions of the defendant for a new trial and in arrest of judgment, entered a judgment on said verdict, from which the defendant prosecutes this…
