Grey Edmiston, the plaintiff, secured at the hands of a jury a verdict against Samuel Kupsenel, the defendant, in the sum of $28,500.00 for personal injuries received in an automobile accident caused by the negligence of the defendant. . ■. :■

Upon motion of the defendant, the trial court ruled that the jury’s verdict was excessive and put the plaintiff on terms to accept an award of $14,250.00 :'or-face a new trial on the issue of damages. The plaintiff, pursuant to the provisions of Code, § 8-3 50 1 , accepted, under protest, the reduced judgment' for- $14,250.00 and excepted to the action…
