ORDER GRANTING IN PART MOTION TO DISMISS AND DENYING MOTION TO TRANSFER VENUE
WILKEN, District Judge.
Defendants move for dismissal of this action pursuant to Federal Rules of Civil Procedure Rule 12(b)(2) and 12(b)(6). In the alternative, Defendants move under 28 U.S.C. § 1404(a) for an order transferring this action to the District of Arizona. Plaintiff opposes the motions. The motions were heard on June 24, 2005.
