Plaintiff, G-eorge S. Kimball,' applied to and obtained from the District Court of Salt Lake County a writ of mandate requiring the defendants to permit bim, as a stockholder of the Continental Life Insurance Company, a corporation organized and existing and doing business under the laws of the state of Utah, to examine the books, records, and papers of the corporation. Plaintiff, after setting forth in bis affidavit the corporate existence of the company, alleges that be is “an actual and tona fide stockholder in said corporation ;” that each of the defendants is a director, and that…
