This appeal and cross-appeal concern the propriety of the district court’s order awarding Plaintiff-Appellee Andrew Kane $25,000 in attorney’s fees under 42 U.S.C. § 1988(b) after Kane obtained a judgment for nominal damages. The underlying action pursuant to 42 U.S.C, § 1983—now before us for the third time—arises from the fatal shooting of Kane’s son, Andrew Cornish, during the execution of a search warrant.
