LYNCH, District Judge.

At the conclusion of the trial I stated as follows:

*936“As I view the facts, the mistake was made in attempting to take the Helen out under the conditions which existed at that time. I cannot find that the tugs made any mistakes in what they did. There is no evidence, certainly not sufficient evidence, on which to base a decision that the tugs acted improperly, or did things which they should not have done.
