The controversy in this case concerns whether plaintiff or defendants are entitled to use the service marks “Esquire” and “Esquire Theatre” in conjunction with the operation of a motion picture theatre business in downtown Chicago. Plaintiff, Plitt Theatres, Inc. (“Plitt”) has filed a complaint against American National Bank and Trust Company of Chicago and 58 East Oak Partnership (“defendants”) seeking to permanently enjoin defendants from using the marks.
