Tommy Padgett appeals from a conviction in the court of common pleas in Tulsa county, where he was charged by information with the unlawful possession of intoxicating liquor. Having waived a jury, he was tried by the court. The defendant was sentenced to serve 30 days in jail, and to pay a fine of $100.

On February 6, 1951, counsel for defendant filed a motion to suppress the evidence. On March 22, 1951, the ease was set for trial for April 2, 1951, but the motion was heard March 28, 1951. The material part of the motion reads:
