BUSSEY, Judge.

Plaintiff in error, Robert L. McDoulett, hereinafter referred to as defendant, Earl L. McDoulett, and J. D. Rogers were charged jointly in case no. 2333 in the District Court of Pawnee County, Oklahoma, by an information filed on the 27th day of January, 1961, said information charging all three defendants with the crime of “Burglary in the Second Degree” of the A. D. Ward Plardware Store in Jennings, Oklahoma, on or about the 13th day of January, 1961.
