This appeal is from a judgment of the district court of Matagorda County— through Hon. C. G. Dibrell, as acting judge thereof — sustaining a general demurrer presented by the appellee to the petition of the appellant, seeking to recover damages for personal injuries sustained by him, while employed by the ap-pellee in the construction of certain drainage works then being done by it in Mata-gorda County; it-was in due manner and form alleged on the pari of the appellant that the negligence of a fellow employee of his', one R.
