This was an action on the part of the plaintiff against the defendant commenced by the service of a summons and complaint on November 10, 1926. The case was tried before Hon. C. J. Ramage and a jury at the October term of the Court of Common Pleas for Darlington County, 1929. A verdict was rendered by the jury in favor of the plaintiff for the sum of $5,000.00 actual damages and the further sum of $5,000.00 as punitive damages.
