On the morning oí September 11, 1926, one Thomas Bowers, while riding in a wagon drawn by a mule along one of the streets of the city of Columbia, this street being also a public highway of the state, was run into and killed by a motor truck, the property of the defendant motor company, driven by one of its employees, the defendant, Wyatt Beachum.
