OPINION
BAER, Justice.
This is a direct appeal from the imposition of a sentence of death by the Court of Common Pleas of Berks County. 1 Following a jury trial in 2000, Richard Boxley (“Appellant”) was convicted of first degree murder and related offenses, arising from his 1997 shooting of Jason Bolton on a street in Reading, Pennsylvania. On December 3, 2003, this Court affirmed the first degree murder conviction, but vacated Appellant’s sentence of death and remanded for a new penalty hearing. Commonwealth v.
