This is a proceeding in error seeking to reverse a judgment of the common pleas court of Muskingum county, Ohio. The parties occupy the same position in this court as in the court below, the basis of the suit being a promissory note for *$152 given to McDonald & Wagner by Herb Schervish in payment of the first premium on a life insurance policy in the Bankers’ Life Insurance Company of Nebraska, which policy was sold by McDonald & Wagner, the agents of said insurance company, to the said Schervish, the note in turn be*89ing sold and transferred by said McDonald & Wagner to the plaintiffs in…
