THIS IS a Chapter 7 liquidation case and the matter under consideration is a Motion to Dismiss the Complaint filed by The Ohio Company (Plaintiff). The Motion filed by Gordon E. Maynard (Debtor) is based on the contention that the Complaint fails to state a claim for which relief can be granted. The claim under challenge is set forth in the Amended Count V, and is supposed to be based on § 727(a)(5) of the Bankruptcy Code.
