Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination by respondent which found petitioner guilty of violating certain disciplinary rules.

While an inmate at Clinton Correctional Facility, petitioner was accused of breaching institutional rules prohibiting the unauthorized exchange of articles, Penal Law offenses, soliciting goods without approval, possessing or exchanging narcotics, and smuggling.
