— Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating a prison disciplinary rule.

Petitioner’s main contention in this proceeding is that the Hearing Officer improperly relied on confidential reports and a confidential statement of a witness to the incident that led to the filing of the assault charge against him.
