Plaintiff brings this action as administrator of the estate of his son, Peter Yerlinde, to recover damages for his death, alleged to. have been caused by the negligence of defendant. Immediately prior to his injury, Peter, then 13 years of age, and an older boy, were unlawfully riding upon defendant’s train of flat cars, which was moving north on a side track at the rate of four or five miles an hour.
