Appellants brought this action in the Montgomery Circuit Court, where, on November 14, 1901, they filed a complaint in three paragraphs. A demurrer filed to each of these paragraphs was overruled as to the first and third and sustained as to the second paragraph. The issues were closed by an answer in general denial. A trial by the court in June, 1902, resulted in a finding and judgment *23for appellees. A motion for new trial was overruled April 23, 1903, and a new trial granted as of right on June 17, 1904.
