Plaintiffs seek compensatory and punitive damages based on defendant’s claimed failure to act with reasonable care or in accordance with its contract with the City of New Haven (“City”) and, based on the same alleged deficiencies, for willful, intentional conduct. Plaintiffs, Associated Construction Company and DeMatteo Construction Company, formed a joint venture (the “JV”) to be the general contractor for a New Haven Sewer Treatment Facility (the “Project”).
