This action was instituted in the superior cou,rt of Pottawai-tomie county, Okla., by W. G. Bennett, as plaintiff, defendant in error, against the city of Shawnee, as defendant., plaintiff in error, to recover damages for injury received by the plaintiff, alleged to have been the result of the negligence of the defendant. Upon the trial of the ease to the court and jufry, judgment was rendered in favor of the plaintiff and against the defendant for $2,000, from which appellant prosecutes this appeal.
