This is a suit to recover damages for loss and injury to property on account of a flood'in the North Canadian river alleged to have occurred October 21, 1908. The action was commenced in the district court of Pottawatomie county on the 23d day of November, 1908, by B. O. Johnson and Charles A. Mantz, as plaintiffs below, against the Missouri, Kansas & Texas Railway Company, plaintiff in error herein, defendant below, wherein it was sought to recover damages on account of the destruction of certain property itemized in the petition.
