MEMORANDUM AND ORDER

YOUNG, District Judge.

I. INTRODUCTION

Ronald W. Carye (“Carye”) commenced this lawsuit on May 19, 2006, alleging, on the behalf of a putative class, that the defendant, Long Beach Mortgage Company (“Long Beach”), failed to comply with the Truth in Lending Act (“TILA”), 15 U.S.C. § 1601 et seq. Compl. [Doc. No. 1] ¶ 12. After Long Beach moved to dismiss [Doc. No. 5], Carye amended his complaint to add two named plaintiffs, a claim pursuant to the Massachusetts Consumer Cost Disclosure Act (“MCCDA”), and an individual claim for rescission under TILA and MCCDA.
