Prom the record in this case it appears that a collision between two automobiles occurred at about 9 o’clock at night near the intersection of two streets, by reason of which plaintiff sustained damages to his automobile, and thereafter brought an action against defendant therefor, which resulted in a judgment on a verdict being rendered in defendant’s favor; and from which judgment plaintiff has appealed to this court.
