MEMORANDUM OF DECISION
ORMA R. SMITH, District Judge.
Plaintiff Bill Keelon (hereafter “Keelon”) is a resident citizen of the State of Alabama. Keelon is the owner of a tractor-trailer rig (hereafter “rig”). The rig was involved in an accident on U.S. Highway 78 in Marshall County, Mississippi, on May 23, 1978.
Defendant Don Davis (hereafter “Davis”), is a resident citizen of Mississippi, and, on the date aforesaid, owned and operated a wrecker service in Marshall County, Mississippi.
