Morrison C. J:

The defendant was prosecuted by information for the crime of murder, and was convicted of that crime in the first degree. The jury failed to fix the punishment, and sentence of death was passed on him by the Court. The record presents a great many exceptions taken to the rulings of the Court, during the progress of the trial, and also several exceptions relating to *389instructions given and refused, which we will notice in the order in which they are presented.
