McFADDEN, Chief Justice.

Plaintiffs-appellants, William Mc-Drummond, Swift & Company, and Globe Indemnity Company instituted this action against defendant-respondent Montgomery Elevator Company, which is engaged in inspecting and maintaining elevators. Mc-Drummond seeks compensation for injuries received when he fell down an elevator shaft after the floor of the elevator car gave way. McDrummond’s employer, Swift & Company, and Swift’s surety, Globe Indemnity Company, seek damages by subrogation for workmen's compensation benefits paid to McDrummond.
