Appellant was convicted, pursuant to a guilty plea, of one count of felony driving under the influence. On direct appeal, appellant argued that one of his prior convictions should have been stricken as constitutionally invalid. Appellant also argued that his case should be remanded to the district court for re-sentencing as a second-offense DUI because the state failed to prove two prior convictions at sentencing.
