— This is an appeal from a judgment in an action of mandamus brought by appellant against the city of Indianapolis and Joseph A. Rink, George B. Gaston and Ernest L. Ziegler, as members of the board of public works of said city. The purpose of the action was to compel appellees by mandate to take such steps as would lead to the adoption of a final assessment roll fixing a lien on property abutting on Thirty-sixth street in said city, between the east line of Pennsylvania street and the west line of Central avenue, to pay the cost of construction of an improvement of that portion of the street…
