MEMORANDUM

CURTIS, District Judge.

In this action the government is seeking forfeiture of a parcel of real estate seized under the authority of Title 21 U.S.C. section 881(a)(6) as property purchased with the proceeds from an illegal drug transaction. Cross-complainant C. Brewer Properties, Inc. asserts that it is an innocent holder of a mortgage upon the property securing a loan to plaintiff Shashin Limited in the sum of $160,998.64. Since the seizure of the property Shashin has defaulted. As a result, Brewer seeks to foreclose the mortgage. These facts having been established by affidavit…
