*1125The instant appeal arises from a proceeding under article 10 of the Mental Hygiene Law, also known as the Sex Offender Management and Treatment Act (hereinafter SOMTA). In 1994 the appellant was convicted, upon a plea of guilty, of sexual abuse in the first degree, based on an incident of alleged rape that occurred on May 14, 1993 and the appellant was sentenced to an indeterminate term of incarceration of 2xk to 5 years.
