Appeal from a judgment of the Supreme Court (Teresi, J.), rendered August 11, 2003 in Albany County, upon a verdict convicting defendant of two counts of the crime of driving while intoxicated.

*945After a jury trial, defendant was convicted of two counts of driving while intoxicated as a class D felony (see Vehicle and Traffic Law § 1192 [2], [3]) based upon the testimony of the arresting police officer and the results of a chemical test of his blood alcohol content (hereinafter BAG).
