Gordon Westergren sued two individuals and a limited partnership, alleging breach of contract with regard to an oral agreement, breach of partnership duties, statutory fraud, and common-law fraud. Defendants National Property Holdings, L.P., Michael Plank, and Russell Plank (collectively, the “Plank Parties”) counterclaimed, alleging breach of contract with regard to a settlement agreement and a release.
