INTRODUCTION
The Court has before it Defendants’ Motion for Summary Judgment (Docket No. 20) and Plaintiffs Motion for Leave to Augment Record (Docket No. 29). The Court heard oral argument on the motions on January 14, 2010 and now issues the following decision.
