Appeal by the plaintiff, William W. Farley, as State Commissioner of Excise, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of New York on the 2d day of July, 1914, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 30th day of June, 1914, denying plaintiff’s motion for a new trial made upon the minutes.

McLaughlin, J.:
Action to recover the sum of $1,800 upon a liquor tax bond given by the respondent Buttner as principal conditioned that he would not violate any of the provisions of the Liquor Tax Law, and in lieu of sureties filed a certificate of deposit in the sum of $2,000 issued by the defendant Guaranty Trust Company of New York.
The complaint alleged, the giving of the bond, the issuance of the liquor tax certificate, and a violation of the bond by selling liquors on five different Sundays during the months of December, 1912, and January, 1913, without serving meals therewith. The…
